REC N’ TREK LTD., its subsidiaries and affiliated companies (collectively  referred to herein as "Company” or “we”, “us”, or “our”) considers user privacy paramount, and we utilize great care in keeping the information of our users private and secure. This Privacy Policy explains our practices in relation to Personal Data collected from users. In this Privacy Policy we want to transparently explain the data that we collect, how we use it and how you can manage such data. 

This Privacy Policy applies to all users ("user", "you" or "your"), whether registered or non-registered users, that visit or use wishtrip.com websites for Travelers or for Enterprise (the "Website"), the WishTrip™ - Travel Experience Network mobile application (the “App”), and the services provided through it (which together with the Website and the App, collectively referred to in this Privacy Policy as the "Service" or “WishTrip”).

From time to time, we may develop new or offer additional service. If the introduction of these new or additional service results in any change to the way we collect or process your Personal Data we will provide you with more information and additional terms or policies. Unless stated otherwise when we introduce these new or additional service, they will be subject to this Privacy Policy.

We encourage you to read this Privacy Policy as well as our Terms and Conditions of Use  (referred to throughout as our “Terms”).

Note to Residents of the European Union: In order to comply with the requirements of the GDPR for our European users, this Privacy Policy outlines the legal basis on which we process your Personal Data and provides other information required by the GDPR.

We collect your Personal Data in a number of ways and for various purposes, as follows:

WishTrip for Travelers:

Sign-Up and Create an Account

You can use some of our Services features, when you’re signed out or without creating an account, such as browsing, searching and viewing public WishTrip profiles. If you do choose to create an account with WishTrip (by signing up with an email address or by sign in/log in with an account in social networking services as Facebook or Google ("SNS")), you would need to provide us with information about you, which includes email address or SNS numeric account identifier and a hashed password. Once you sign up for an account, you can select a username (usernames are unique identifiers on WishTrip).

We process this data for registration and authentication purposes of creating account and verifying the identity of users who are logged into their WishTrip account. You are not obliged to provide this information to us, however, if you don't provide such information, we will not be able to create your account.

The legal basis for this processing is our legitimate interest because it is necessary to enable users to log into their WishTrip account, as well as conducting necessary verification to prevent unauthorized access to their account.

Profile Information

When you create an account with us, you may choose to personalize your account by entering and providing information on your WishTrip profile. We may collect Personal Data from your profile such as profile picture, language, gender, date of birth, age, and marriage status.

If you choose to sign-in/log-in to WishTrip using your SNS account(s), we may collect Personal Data that you have provided to that SNS. For example, when you log in with your Facebook credentials, we may collect Personal Data from your Facebook profile that is permitted under Facebook's Terms of Use - such as your profile picture, gender and date of birth. If you do not want to provide us with this data, you need to adjust the privacy settings on your SNS account.

We process this data for the purposes of personalization and to conduct analytics (on aggregate basis) to improve the Service. You are not obliged to provide this information to us, however, if you don't provide such information, we will not be able to provide you with some features within our Service.

Our legal basis for this processing is our legitimate interests, because it is necessary to enable us to develop, personalize or otherwise improve the Service and the user experience we offer to our users. Also, it is necessary for our Enterprise Customer(s) (which we share with them such anonymized-aggregated data about our Travelers users), to develop or otherwise improve their Site within WishTrip and the user experience they offer to visitors using their Site.

Communications and Marketing Messages

When you contact us or sign up to receive information and Marketing Messages (as defined below), we may collect contact information that you provided to us, including email address, mobile number, Chat ID, etc.

We may use this data to contact you or send you, from time to time, through email, push notifications, notices posted on our Websites or App, text messages, Chat or other ways through our Service: (i) marketing messages and information about WishTrip which may be of interest to you, such as newsletters, offers, new marketing brochures, new product/service launches, promotions and more (“Marketing Message(s)”); as well as to send you (ii) notifications pertaining to the performance of our Service, such as revision of our Terms or this Privacy Policy or other formal communications relating to the Service. We also use this data to respond to you when you contact us, including to your requests for technical support or to any other inquiries or communication you initiate (“Communications”).

Our legal basis for the processing of this information for the purpose of Marketing Message(s) is your consent. Will ask for consent via an opt-in, and we’ll send you Marketing Messages only if you have opted-in to receive those messages. You can opt-out receiving these Marketing Message(s), by contacting us using the following email address: contact@wishtrip.com or by following any instructions we may include in the Marketing Message(s) we send to you (for example, an unsubscribe or opt-out mechanism will appear at the foot of any Marketing Message or email notification we send you).

Our legal basis for the processing of this information for the purpose of Communications with you, is our legitimate business interest in responding to your communications in a consistent way, and in providing you with information about the Service we offer, that we think he/she may find interesting, for example sending a user that sign-up to our Service a message regarding technical updates, or a new features in our App. You can control or opt-out receiving these Communications by contacting us using the following email address contact@wishtrip.com however, if you send us an email after you opted-out, we cannot respond to your email.

Location Data

When you use the Service, we will collect and process location data as part of the functionality of our Service, such as to provide route maps, route tracking and points of interest.

We may collect such location data from the device on which you use the Service.

Our legal basis for this processing is your consent. Your device asks for your consent before WishTrip first uses location (through device/browser settings: ‘Allow to Access Location’ or ’Turn-On Location Service’), and you can withdraw that consent at any time via the device's settings. If you are accessing the Service through the App, the way we collect location data will differ depending on your mobile device's operating system. In all events, we do not collect precise Location Data, unless you have "allowed" its collection. If you decline to allow location data collection in the App, we will not collect your precise location data unless you manually enter it in.

Content Information

We may collect information in or about the content you create, post, upload and/or share within WishTrip, including any content you provide through messages, chat, or other functionality, such as: recording a trek (a recorded journey, a history of positions and times, treks navigated by user); Trek Live Share; point of interest; adding a speed traveling, trek name, trek description, general trek attributes and/or free text notes. You can also allow the App to access and use your camera or other external camera, allowing you to take and upload photos, audio and videos within the App, and you can withdraw that permission at any time via the device's settings (collectively, “Content”).

We use this information to operate, maintain and provide to you the main features of the Service. You are not obliged to provide this information to us, however, if you don't provide such information, you will not be able to use the Service.

This processing is necessary for our legitimate interests, namely enabling us to operate the main functionality of the Service.

Contribution Data

When you make a contribution through the Website or App to an Enterprise Customer we may collect and process data related to your contribution such as: date of contribution, contributor's user mane as appears in the contribution form, contribution amount and campaign, and any dedication of the User (if applicable) (collectively "Contribution Data").

You can make the contribution on anonymous basis by ticking the box "make me anonymous". Note that if you do not tick such box then your contribution will be public and a notification will be sent to your followers and other WishTrippers that are visiting the Enterprise Customer site to encourage them to participate in the contribution campaign.

We use the Contribution Data for archive purposes, to allow the functionality of the contribution feature of our Service, and in order to allow the user access to his contribution details as part of his user account.

This processing is necessary for our legitimate interests, namely enabling us to operate the contribution feature in our Service

Device Information

As described below, we collect information from and about the devices you use with our Service. Information we obtain from these devices includes: information such as the operating system, browser type, unique identifiers, device IDs, data you allow us to receive through device settings you turn on (such as access to your GPS location, camera or photos), information such as the name of your mobile operator, language, time zone, mobile phone number, and IP address.

Part of that information may be treated as Personal Data in accordance with applicable local law.

We use this information to provide you with better user experience, to administer our Service and for internal operations such as troubleshooting, data analysis and research and statistical purposes.

We use this information because we have a legitimate business interest to monitor and improve your user experience with our Service.

Social Information

You can choose to use range of social features in our Service, including to follow another user, in which case you see the content they choose to share in your personalized activity feed, and that you follow them is visible to them and others. Another user may follow you and thus see the content you share in their own feed. You can comment, rate/rank and review routes that you have followed.

The processing of the information we collect through supporting these social interactions, is necessary for our legitimate interests, to provide users with better user experience of our Services.

Aggregated and Anonymized Information

We may aggregate and create de-identified or anonymous data from Personal Data you provided to us (such as gender, age, age range and marriage status, language, location-based density maps), by excluding data components (such as your name, email address, or linkable tracking ID) that makes the data personally identifiable to you, through obfuscation, or through other means.

We use this information to provide statistical and analytics data, on an aggregate basis, for us to share with our Enterprise Customers.

We also may process aggregate personal information about user’s search, such as: search term, location, language and search filters, to personalize user’s searches.

Our legal basis for this processing is our legitimate interests, because it is necessary for our business to share such information with our Enterprise Customer(s) so they can enhance, develop, modify or otherwise improve the Site they offer to visitors/Travelers’ users of WishTrip. Also, by facilitating efficient searches and analysis of user’s search pattern, we can optimize the personalized search for users which is important for improving our App and providing better user experience.

WishTrip for Enterprise:

Contact and Inquiries Information

When you visit our Website as an Enterprise Customer or prospective/potential customer (or a person acting on its behalf), we may collect certain Personal Data that you choose to submit to us through an online form (e.g. our "Let’s talk").

Such information may include Personal Data you provide us as an Enterprise Customer or prospective/potential customer or as an interested visitor to our Website, regarding requests for additional information about the Service or for other purposes. This Personal Data may include for example: your first name, last name, company name and Email address.

We use such Personal Data to communicate with you and respond to specific requests for information about our Service and other inquiries.

We also use this Personal Data to develop new Service and to improve or personalize our existing Service.

You do not need to provide this information to us, however, if you don't provide such information, we will not be able to respond to your communication and requests.

We use this information because we have a legitimate business interest in responding to your communications in a consistent way, in providing you with information about the Service we offer, and about which you have expressed an interest or that we believe will be of benefit to you, and in understanding customer/potential customer feedback and in. Where appropriate, we will obtain your consent at the time we communicate with you.

Interactions with our Service

As part of our business relationship with our Enterprise Customers we collect Personal Data of the natural persons within the Enterprise Customer organization that interact with our Service or as part of our business relationship.

For example, as part of the Service, the Enterprise Customer opens a designated account in our Site platform through which it uses our Service. For each Site account the Enterprise Customer appoints admin users. We collect the following information on the Enterprise Customer's admin users and their use of the Service: first and last name, phone number, Email address, organization/company name.

We use this information for purposes of providing the Service and complying with contractual obligations, managing our relationships with Enterprise Customers, communicating with Enterprise Customers and provide customer support.

The legal basis for this processing are performing the contract that we have entered into with the Enterprise Customers and our legitimate business interest in managing our relationships with Enterprise Customers.

Marketing

If you are an Enterprise Customer or prospective/potential customer (or a person acting  on their behalf) or even just a visitor of our Website, that sign-up for our Marketing Message(s), we may process the contact information that you provided to us, including your contact name, business/company name, phone number and Email address for marketing purposes.

We may send you, from time to time (by email, SMS text or other electronic means) marketing information about the Company and the Service which may be of interest to you, such as newsletters, offers, new marketing brochures, new product/Service launches, technical updates, promotions and more (“Marketing Message(s)”).

For some aspects of our marketing and under certain jurisdictions our legal basis for processing is our legitimate interest to provide an Enterprise Customer with great service and information that we think he/she may find interesting, for example sending an Enterprise Customer that subscribed to one of our Service a Marketing Message(s) regarding a new Service or new features in our App.

For other aspects of marketing and in certain jurisdictions that don't allow legitimate interest as lawful basis for marketing our legal basis for this processing is your consent. Will ask for consent via an opt-in or soft opt-in which is explained below.

You may decline to receive Marketing Message(s) from us by contacting us using the following email address: contact@wishtrip.com or by following any instructions we may include in the Marketing Message(s) we send to you (for example, an unsubscribe or opt-out mechanism will appear at the foot of any Marketing Message we send you).

Soft opt-in consent is a specific type of consent which applies where you have previously engaged with us (for example if you are already an Enterprise Customer and showed interest in our Service), and we are marketing other related Service. Under ‘soft opt-in’ consent, we will take your consent as given unless or until you opt out. For most people, this is beneficial as it allows us to suggest other Service to you alongside the specific one you applied for.

Website Usage Data

When you visit our Website we collect certain information, including but not limited to your IP address (a computer's numerical Internet address), the websites from which you access our Website, the type of web browsers used to access our Website, the operating system, length of visit, page views and website navigation paths, as well as information about the timing, frequency and pattern of your use of the Website. Part of that information may be treated as Personal Data in accordance with applicable local law.

We use this information to provide you with better user experience, to administer our Website and for internal operations such as troubleshooting, data analysis and research and statistical purposes.

We use this information because we have a legitimate business interest to monitor and improve your user experience with our Website, including by understanding how our Website is accessed, how it is used and any problems users have with it, and to ensure that the Website is secured.

WishTrip for all users

We will also disclose Personal Data (1) in response to lawful requests by government or regulatory authorities; and (2) in our sole discretion if we believe that such disclosure is appropriate in connection with an official government or regulatory investigation or in response to a perceived significant threat to a person's health or property. 

We may also process any of your Personal Data identified in this Privacy Policy where necessary for the establishment, exercise or defense of legal claims, whether in court proceedings or in an administrative or out-of-court procedure. We will not delete Personal Data if relevant to an investigation or a dispute. It will continue to be stored until those issues are fully resolved.

The legal basis for this processing is our legitimate interests, namely the protection and assertion of our legal rights, your legal rights and the legal rights of others.

In addition to the specific purposes for which we may process your Personal Data set out above, we may also process any of your Personal Data where such processing is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

HOW YOUR PERSONAL DATA IS SHARED

Affiliates

We may share any or all of your Personal Data with any affiliates or subsidiaries or partners of the Company, insofar as reasonably necessary for the purposes, and on the legal bases, set out in this Privacy Policy.

Service Providers

We may sometimes contract with third parties to supply products and services to us and/or to you on our behalf (such as with Applozic, who provide us the Chat API services). Such service providers are required by contract to keep confidential and secure the Personal Data received on our behalf and may not use it for any purpose other than to carry out the service they are performing for us. In some cases, the third parties may require access to some or all of your Personal Data. Where any of your Personal Data is required for such purpose, we will take all reasonable steps to ensure that your Personal Data will be handled safely, securely, and in accordance with your rights, our obligations, and the obligations of the third party under the applicable law.

Publicly Available Information

Parts of our Service allow users to upload user Content to their WishTrip account. It is your choice whether to include personal information within the Content on your account, and you can control the privacy and choose whether that information is public or private, so visible to the public (or other users) or not, by using the Setting page.

If you make your ‘Private Treks’ public; upload content with a public status; follow another user; or download routes; that may show in the activity feeds. You can choose to publish routes, in which case it becomes public, other people can view or download a copy.

Enterprise Customer(s)

We may from time to time share Aggregated and Anonymized Information with third parties such as our Enterprise Customers who entered into a contract with us. All such data will be anonymized and will not include any personally identifying data, or any anonymized data that can be combined with other data and used to identify you. Such data will only be shared and used within the bounds of the law.

Other Circumstances

In certain circumstances, we may be legally required to share certain data held by us, which may include your Personal Data, for example, where we are involved in legal proceedings, where we are complying with legal obligations, a court order, or a governmental authority as further set forth under Legal Requirements

We may disclose personal information if you give us your explicit consent.

 

RETAINING AND DELETING YOUR PERSONAL DATA

We keep your Personal Data only as long as necessary for that purpose or those purposes for which that data is collected, held and processed, and as permitted or required by law. For example, your Personal Data will retained while your account remains open, or if you are an Enterprise Customer we keep your contact information for a long as we have or may have a business relationship, or for example if you subscribe to our newsletter for as long as you don't opt-out from such subscription.

In addition, we may retain your Personal Data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

All such retention will be subject to the implementation of appropriate technical and organizational measures to protect the rights and freedoms of data subjects, as required by applicable law.

If you request, we will delete or anonymise (to the extent applicable) your Personal Data so that it no longer identifies you, unless we are legally allowed or required to maintain certain Personal Data as further explained below regarding The Rights You Have Over Your Personal Data

 

HOW DO WE PROTECT THE SECURITY OF YOUR PERSONAL DATA

We implement and maintain reasonable and appropriate technical and organizational security measures to protect the Personal Data we process, from unauthorized access, alteration, disclosure, loss or destruction.

Should despite our security measures, a security breach occur that is likely to result in a risk to the data privacy of a data subject, we will inform the relevant data subjects and other affected parties, as well as relevant authorities when required by applicable law, about the security breach as soon as reasonably possible.

WHERE DO WE STORE YOUR PERSONAL DATA

We store your Personal Data on third-party servers operated by well recognized hosting companies such as AWS in compliance with the applicable data protection legislation.

If you are a resident of the European Economic Area (EEA consists of all EU member states, plus Norway, Iceland and Liechtenstein) we will store your Personal Data on servers located within the EEA (e.g. AWS Ireland) in accordance with the General Data Protection Regulation or GDPR. However, under the definition of processing in the GDPR, having access to such Personal Data means that such Personal Data is "transferred" therefore, you  know that your Personal Data may be "transferred" to a country outside the EEA or to an international organization, (I) which the European Commission has made an "adequacy decision" with respect to the data protection laws of such country; or (II) which is certified and covered by the EU-US Privacy Shield framework; or (II) by way of data transfer agreement, incorporating the current standard contractual clauses adopted by the European Commission for the transfer of Personal Data by data controllers in the EEA to data controllers and processors in jurisdictions without adequate data protection laws. We will take all steps to ensure that any Personal Data which is transferred to country outside the EEA is treated as safely and securely at the same levels of protection as it would be within the EEA and in accordance with the applicable European Data Protection Law.

The rights EU residents have over their Personal Data

One of the GDPR main objectives is to protect and clarify the rights of EU residents with respect to processing of Personal Data. This means that if you are an EU resident you retain various rights in respect of your Personal Data, even once you have given it to us. The main rights are described in more detail below:

Right of Access - You have the right to confirmation as to whether or not we process your Personal Data and, where we do, access to the Personal Data, together with certain additional information. That additional information includes details of the purposes of the processing, the categories of Personal Data concerned and the recipients of the Personal Data. Providing the rights and freedoms of others are not affected, we will supply to you a copy of your Personal Data in accordance to the GDPR requirements. The first copy will be provided free of charge, unless your request is "manifestly unfounded or excessive". If you request further copies of this information from us, we may charge you a reasonable administrative cost where legally permissible. Where we are legally permitted to do so, we may refuse your request. If we refuse your request we will always tell you the reasons for doing so.

 

Right to Rectification- You have the right to request that we rectify any inaccurate or incomplete Personal Data that we hold about you. If we have shared this Personal Data with third parties, we will notify them about the rectification unless this is impossible or involves disproportionate effort. Where appropriate, we will also tell you which third parties we have disclosed inaccurate or incomplete Personal Data to. Where we think that it is reasonable for us not to comply with your request, we will explain our reasons for this decision.

 

Right to Erasure - In some circumstances you have the right to ask us to delete any Personal Data we hold about you without undue delay. Those circumstances include: the Personal Data are no longer necessary in relation to the purposes for which they were collected or otherwise processed; you withdraw consent to consent-based processing; you object to the processing under certain rules of applicable data protection law; and the personal data have been unlawfully processed. However, there are exclusions of the right to erasure. The general exclusions include where processing is necessary: for compliance with a legal obligation; or for the establishment, exercise or defence of legal claims.

Right to restrict processing- Under some circumstances you have the right to restrict the processing of your Personal Data. Those circumstances are:

Where processing has been restricted on this basis, we may continue to store your Personal Data. However, we will only otherwise process it: with your consent; for the establishment, exercise or defence of legal claims; for the protection of the rights of another natural or legal person; or for reasons of important public interest.

Right to withdraw consent- To the extent that the legal basis for our processing of your Personal Data is consent (e.g., for marketing purposes), you have the right to withdraw that consent at any time. If you make such withdraw, we will cease to process your Personal Data for this purpose, provided that such withdrawal will not affect the lawfulness of processing before the withdrawal. If the processing is not based on consent, you have the right to object to the processing.

Right of data portability- If you wish, you have the right to transfer your Personal Data between data controllers. In effect. To allow you to do so, we will provide you with your Personal Data in a commonly used machine-readable format that is password protected so that you can transfer the data to another online platform. Alternatively, we may directly transfer the data for you. This right of data portability applies to: (i) Personal Data that we process automatically (i.e. without any human intervention); (ii) Personal Data provided by you; and (iii) Personal Data that we process based on your consent or in order to fulfil a contract.

 

Right to object- this right enables you to object to us processing your Personal Data where we do so for one of the following four reasons: (i) our legitimate legit interests; (ii) to enable us to perform a task in the public interest or exercise official authority; (iii) to send you direct marketing materials; and (iv) for scientific, historical, research, or statistical purposes. The "legitimate interests" and "direct marketing" categories above are the ones most likely to apply to you. If your objection relates to us processing your personal data because we deem it necessary for our legitimate interests, we must act on your objection by ceasing the activity in question unless: (A) we can show that we have compelling legitimate grounds for processing which overrides your interests; or (B) we are processing your Personal Data for the establishment, exercise or defence of a legal claim.

 

Right to lodge a complaint with a supervisory authority- You also have the right to lodge a complaint with your local supervisory authority.

If you have any cause for complaint about our use of your Personal Data, please contact our Data Protection Officer at: dpo@wishtrip.com and we will do our best to solve the problem for you. If we are unable to help, you also have the right to make a complaint to the applicable data protection supervisory authority.

WHAT HAPPENS IF OUR BUSINESS CHANGES HANDS

We may from time to time, expand or reduce our business and this may involve the sale and/or the transfer of control of all or part of our business. Where permitted by law, any Personal Data that you have provided to us will, where it is relevant to any part of our business that is being transferred, be transferred along with that part and the new owner or newly controlling party will, under the terms of this Privacy Policy, be permitted to use that data only for the same purposes for which it was originally collected by us.

THIRD PARTY WEBSITES

This Privacy Policy applies only to your use of our Service and Website. Our Website may contain links to other websites neither owned nor managed by us. Please note that we have no control over how your data is collected, stored, or used by other websites and we encourage you to review the privacy policies of any such websites before providing them of or allowing the collection of your Personal Data. The Personal Data you choose to provide to or that is collected by these third parties is not covered by our Privacy Policy. We would like to emphasize that we are not responsible for the content or the privacy policies of websites to which our Website may link or websites that link to our Website.

OUR SERVICE ARE NOT INTENDED FOR CHILDREN

Our Website is meant for adults. We do not knowingly collect any information about children under the age of 13. Although we make reasonable efforts to ensure that children do not use our Website, we cannot guarantee that we have not received information related to your child’s online activities. If we become aware that we have collected information about a child under the age of 13, that information will be immediately deleted from our database. If you believe your child has provided us with Personal Data, please contact us at: dpo@wishtrip.com to have the data provided by and associated with your child deleted.

CHANGES TO OUR PRIVACY POLICY

We may change this Privacy Policy from time to time by updating this page and publishing a new version on our Website. If this happens, we will post a notice on our Website that changes were made in our Privacy Policy and we will change the “Last Updated” date at the top of this Policy. Any such changes will become binding on you on your first use of our Website after the changes have been made. Therefore, following such notice, we highly recommend that you should check this revised policy, to ensure that you are happy with any changes.

DEFINITIONS

In this Privacy Policy, the following terms shall have the following meanings:

Enterprise Customer(s)” – means our paying contractual customer(s) who has a contractual arrangement with us for the provision of the Service, and who use WishTrip product for Enterprise (“Site”).

GDPR” – means the EU Regulation 2016/679 General Data Protection Regulations, as amended, consolidated or replaced from time to time;

Personal Data” – means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;
